These Terms of Service ("Terms") govern your access to and use of MotorDesk (the "Service"), operated by Spartan Media LLC ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms.
1. The Service
MotorDesk is a multi-tenant SaaS platform for U.S. auto repair shops, providing tools for customer and vehicle management, quoting, work orders, scheduling, billing, and AI-assisted recommendations.
2. Accounts
- You must be at least 18 and authorized to bind your shop to these Terms.
- You are responsible for safeguarding your credentials and for all activity under your account.
- You agree to provide accurate, current information and update it as needed.
3. Trial & Subscription
The Service is offered with a free trial period (15 days by default; longer trials may apply for promos). A valid payment method is required to start. After the trial, you will be billed automatically per the plan and seat count on file via Stripe. You can cancel any time from the billing portal; cancellation takes effect at the end of the current period. Fees are non-refundable except where required by law.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or deceptive purpose.
- Attempt to reverse engineer, decompile, or circumvent security controls.
- Upload malware, scrape data, or overload our infrastructure.
- Use the Service to send unsolicited bulk communications.
- Share or resell access to the Service without our written consent.
5. Customer Data
You retain all rights to the data you input. You grant us a limited license to host, process, and display your data solely to provide the Service. You are responsible for the lawfulness of data you enter, including obtaining consent from your customers where required.
6. AI Features
AI-generated suggestions (e.g., service recommendations) are assistive only and do not replace the judgment of a qualified technician. We are not responsible for decisions made based on AI output. Critical mechanical assessments must always be verified by a licensed professional.
7. Intellectual Property
MotorDesk, its logos, code, design, and content are owned by Spartan Media LLC and protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works without our written consent.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the event. We are not liable for indirect, incidental, special, or consequential damages, or lost profits.
10. Termination
We may suspend or terminate your access if you breach these Terms or fail to pay. You may cancel any time. Upon termination, your right to use the Service ends; data is retained per the Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Florida.
12. Changes to the Terms
We may modify these Terms at any time. Material changes will be announced inside the app or by email. Continued use after changes constitutes acceptance.
